The Transgender Persons (Protection of Rights) Bill, 2016, will violate the fundamental rights guaranteed by a landmark Supreme Court judgement to intersex and trans people, said social activists, addressing the media on Thursday. The Bill is expected to be tabled in the winter session of the Parliament, which begins on Friday.
On April 15, 2014, the Supreme Court passed the famous NALSA (National Legal Services Authority vs Union of India government) judgment, which affirmed the fundamental rights of trans people and upheld the right of self-identification of their gender as male, female or transgender, irrespective of harmonal therapies and surgeries.
However, the new Bill is contradictory to the SC judgment, the activists alleged. The very definition of transgender, as given in the Bill is wrong, said A Jaya, general manager of Sahodaran, a non-governmental organisation (NGO) working for welfare of the LGBTQIA (an initialism of lesbian, gay, bisexual, transgender, queer/questioning, intersex and asexual/allied).
According to the new draft Bill, a transgender person is one who is neither wholly female nor wholly male or a combination of female or male or neither female not male. “While the NALSA judgment recognises the third gender, the Bill does not. This cuts any scope for reservation in education or employment,” she said.
